This Terms and Conditions ("Terms") agreement ("Agreement") constitutes a legally binding agreement between you ("User", "you" or "your") and ThirtyPlus ("Company", "we", "us" or "our") governing your access to and use of the ThirtyPlus website ("Website") and services ("Services"), including our mobile applications and related platforms. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.
  • You must be at least 13 years old to use our Services. By using our Services, you represent and warrant that you are at least 13 years of age.
1. ACCOUNT REGISTRATION
To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
2. SERVICES DESCRIPTION
ThirtyPlus provides an adaptive ACT preparation platform ("Services") that includes practice questions, adaptive missions, mastery tracking, and AI-powered explanations. We offer a free tier ("ThirtyPlus Free") and a premium tier ("ThirtySix") with enhanced features including root-cause analysis, confidence calibration, personalized study planning, and advanced analytics. Features, pricing, and availability are subject to change.
3. SUBSCRIPTIONS AND BILLING
ThirtySix subscriptions are billed in advance on a monthly ($9.99/month), quarterly Prep Pass ($24.99/3 months), or lifetime ($129 one-time) basis. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Cancellations take effect at the end of the current billing cycle. Refunds are not provided for partial periods. Prices are in USD and subject to change with notice.
4. INTELLECTUAL PROPERTY
All content, features, and functionality of the Services (excluding User Content) are owned by ThirtyPlus and protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without prior written consent.
5. USER CONTENT
You retain ownership of content you submit. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content solely to provide the Services. You represent you have the right to grant this license.
6. PROHIBITED CONDUCT
You agree not to: (a) violate any law or regulation; (b) infringe intellectual property; (c) transmit viruses or malicious code; (d) scrape, crawl, or harvest data; (e) reverse engineer the Services; (f) share accounts or credentials; (g) use the Services for commercial purposes without consent; (h) interfere with other users' enjoyment.
7. DISCLAIMERS
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION. ThirtyPlus is not affiliated with, endorsed by, or sponsored by ACT, Inc.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIRTYPLUS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.
9. INDEMNIFICATION
You agree to indemnify and hold ThirtyPlus harmless from claims arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
10. TERMINATION
We may terminate or suspend your access immediately, without prior notice, for breach of these Terms. Upon termination, your right to use the Services ceases. Provisions that should survive termination shall survive.
11. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws. Disputes shall be resolved through binding arbitration under JAMS rules, or in small claims court. Class actions are waived.
12. CHANGES TO TERMS
We may modify these Terms at any time. Material changes will be communicated via email or prominent notice. Continued use constitutes acceptance.
